Terms of business (AGB)
Terms of business (AGB) of SHOP24. Version 4.1, valid from 1 January 2026.
§ 1 Scope
These terms apply to all offers, contracts and deliveries between SHOP24 (“SHOP24”) and its customers. Deviating terms of the customer do not become part of the contract unless expressly accepted by us in writing.
§ 2 Offers and conclusion of contract
Presentations of hardware on this website are non-binding and do not constitute an offer. A contract is concluded exclusively by our written offer and the customer’s written acceptance, or by our written order confirmation. Offers remain valid for 14 calendar days unless otherwise stated. Stock availability is subject to prior sale.
§ 3 Prices and payment
All prices are quoted individually per offer, in euro, and are stated net plus statutory VAT where applicable. Intra-community supplies are invoiced without VAT upon presentation of a valid VAT identification number. Invoices are payable within 14 days of the invoice date without deduction, unless otherwise agreed. For new customers we may require advance payment or payment against pro-forma invoice.
§ 4 Delivery
Delivery dates stated in an offer are approximate unless expressly designated as binding. Partial deliveries are permitted where reasonable for the customer. Risk passes to the customer upon handover to the carrier in the case of commercial buyers, and upon receipt of the goods in the case of consumers.
§ 5 Retention of title
Delivered goods remain our property until all claims arising from the business relationship have been settled in full. The customer may not pledge or assign the goods as security before title has passed.
§ 6 Condition of refurbished goods
All hardware supplied is used and professionally refurbished. Cosmetic condition is described by the grade stated in the offer in accordance with our published grading scale. Deviations in cosmetic appearance within the stated grade do not constitute a defect. Battery components are wear parts; the residual capacity stated in the offer is the agreed condition.
§ 7 Warranty
For commercial buyers the warranty period for used goods is 12 months from delivery, or the extended term expressly agreed in the offer. Consumers receive the statutory warranty, reduced to 12 months for used goods pursuant to § 476 (2) BGB. Claims require the customer to notify obvious defects in writing within 7 days of receipt.
§ 8 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. In cases of slight negligence we are liable only for breach of a material contractual obligation, limited to the foreseeable damage typical for this type of contract. Liability for data loss is limited to the effort required for restoration from properly maintained backups.
§ 9 Data on returned hardware
Customers are responsible for erasing their own data before returning hardware to us. Upon request we perform certified erasure in accordance with our service description.
§ 10 Final provisions
German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of performance and, for merchants, the place of jurisdiction is Weil am Rhein. Should individual provisions be invalid, the validity of the remaining provisions is unaffected.
